Robert F. Kennedy, JR. Filing Dates: October 26, 2026 and October 27, 2026 Overview A 2023 Rule retroactively applied “entitled to benefits under Part A for pre 2014 adjustments.” On October 26, 2026, HHS appealed the August 28, 2026 District Court decision that determined the 2023 Rule was unlawful and which ordered vacatur of the Rule to the United States Court of Appeals for the District of Columbia Circuit. On October 27, 2026, Montefiore also appealed to the United States Court of Appeals for the District of Columbia Circuit presumably not satisfied by the lower court's termination of the case and remand to CMS for an additional attempt at remedy.
